Litigants in Small Claims and Family Law Act cases in the Provincial Court who cannot meet filing or other deadlines because of the BC wildfires can request an extension.

Small Claims

In Small Claims cases, litigants can request an extension under Small Claims Rules 16(6.1)(c) and 17(12). You can complete and file the form online by clicking on “Filing Assistant” next to Application to a judge (SCR Form 17, SCL017) on the Government of BC Small Claims forms page. This process does not require a court hearing.

Family

In Provincial Court Family Law Act cases, litigants can request an extension under Provincial Court Family Rules 62(j) and 65. To apply, you can file an Application for Case Management Order without Notice or Attendance Form 11. You will not need to give advance notice to other parties, or have a court hearing, unless a judge decides otherwise. Or, if you want to apply for an order by consent or if you want a court appearance, you can instead use the Application for Case Management Order Form 10. Both forms are available on the Government of BC Provincial family forms page, and can be completed and filed online using the Family Law Act Online Forms Service.
